THE PORSCHE X BACKDROP  MAIN STAGE GIVEAWAY OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Eligibility: The Porsche X Backdrop Main Stage Giveaway (The “Sweepstakes”) is open only to registered attendees (as of 9/27/23) of the Rennsport Reunion 7 event at the WeatherTech Raceway Laguna Seca, Salinas, CA, on 9/28/2023 – 10/1/2023 (the “Event”) who are legal residents of the fifty (50) United States and/or the District of Columbia, and are 18 years of age or older as of the date of entry (“Entrant”). Void outside the Event and where prohibited by law. Employees of Sponsor, its parent, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional and judging agencies (collectively “Released Parties”), their immediate and extended family members (including but not limited to spouses, domestic partners, parents, children, and siblings and their respective spouses, regardless of where they reside) and household members of each (whether related or not) are not eligible to participate or win. All federal, state and local laws and regulations apply. Entry constitutes Entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.

2. Sweepstakes Period: The Sweepstakes begins at 7:00 am Pacific Time (“PT”) through 6:30 pm PT daily from September 28, 2023 through September 30, 2023 and 7:00 am PT through 3:00 pm PT on October 1, 2023 (“Sweepstakes Period”). The Sweepstakes Period will consist of four (4) daily periods (each an “Entry Period”). Entry Periods are detailed in the chart below in #7.

3. How to Enter: Entrants must visit the Porsche Backdrop space on Main Street at the Event and see an on-site representative who will direct them to a kiosk or device, where an online form must be completed to earn one (1) entry into the Sweepstakes for that Entry Period only (“Entry”). Limit one (1) Entry per Entrant/valid email address, per day, during the Sweepstakes Period. Entries will not be carried over into any subsequent Entry Period(s). Any attempt by any Entrant to enter by using multiple/different email addresses, mailing addresses, identities, registrations, or any other methods will void such Entries and that Entrant may be disqualified. Use of any automated or computer system to participate is prohibited and will result in disqualification.

4. Random Drawings/Odds of Winning: On or about 4:30 PM PT of each Entry Period, there will be one (1) prize winner (as broken out below) randomly selected from among all eligible Entries received during that Entry Period. Drawings will be conducted by the Sponsor, whose decisions are final and binding on all matters related to the drawing. Winners will be announced at approximately 4:50 PM PT, each Entry Period, at the Main Stage. Prize winners will be sent a Declaration of Eligibility and Publicity Release, as defined below, via the email address provided during Entry. Winner does not need to be present to win. The odds of winning a prize depend on the total number of eligible Entries received during each Entry Period

5. Prize Winner Notification: Potential winners of Entry Periods 1 through 3 are required to complete, sign and return Declaration of Eligibility and Liability Release and except where prohibited, publicity release (“Declaration”) within three (3) days of notification in order to be confirmed a winner. If a potential winner is present on-site he/she may see a Porsche USA on-site representative to obtain, complete and submit the Declaration by 6:30 pm PT on the day that the prize is won and schedule their Sponsor-specified demo lap . If a potential winner of Entry Periods 1-3 are not present on-site or do not see a Porsche USA on-site representative at the event by 6:30 pm PT on the day that the prize is won, a Declaration will be provided via DocuSign link to the email address provided during registration and must be completed, signed and returned within three (3) days of notification.  If any potential winner fails to return the completed Declaration within three (3) days, Declaration is returned as “undeliverable”, Entrant will be deemed to be ineligible, the prize will be forfeited and an alternate potential winner will be notified, [up to three (3) attempts to secure a winner for each Entry Period prize will be made, with the exception of Entry Period 4, where only 1 attempt will be made or prize will go unawarded].

6. Prizes and Approximate Retail Values (“ARV”): There will be four (4) prizes awarded, one per Entry Period of the Sweepstakes Period. See the chart below for details:

Prize Restrictions: Limit one prize per person. Prizes cannot be substituted, assigned, transferred, or redeemed for cash; however, Sponsor reserves the right to make equivalent prize substitutions at its sole discretion if advertised prize (or portion of prize) becomes unavailable. Gift certificate and Gift cards are subject to expiration dates, terms and conditions. In the event any component of any prize are cancelled or postponed due to circumstances beyond Sponsor’s control, Sponsor reserves the right to offer a prize of equal or greater value. Some prize components may require winner to complete and sign a waiver in order to participate. Winners are responsible for any loss of prize after it has been delivered. Sponsor will not replace any lost or stolen prize. Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of prize not specifically stated herein are the sole responsibility of the winners. All Prize winners will be issued a 1099 tax form for the actual value of the prize. Winners must complete the demo lap on the day that the prize is won or any day that they are a registered attendee (as of 9/27/23) or that portion of the prize may be forfeited.

In the event that any winner engages in behavior during their prize activity or experience (as applicable), as determined by Sponsor in its sole discretion, to be objectionable or  illegal, or that is intended to threaten or harass any other person, or that in any way disparages or adversely affects the reputation, image, and/or customer goodwill of Sponsor or any of Sponsor’s services, products, trademarks, service marks, or logos, Sponsor reserves the right to terminate that portion of their prize, with no further obligations or compensation whatsoever to winner [which may, in Sponsor’s sole discretion, result in that winner’s disqualification from the Sweepstakes and forfeiture of any (and/or all) of the remaining prize(s)].  In the event that any winner engages in behavior during their prize activity or experience (as applicable), as determined by Sponsor in its sole discretion, that is illegal, tortious, or subjects that winner to arrest or detention, Sponsor shall have no obligation to pay any damages, fees, fines, judgments or other costs or expenses of any kind whatsoever incurred by such winner.

7. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion and in the event of cancellation, the prizes (broken out per Entry Period) will be awarded in a random drawing from among all eligible entries received per Entry Period prior to cancellation. Released Parties, and their agencies are not responsible for lost, late, incomplete, damaged, stolen or misdirected entries; lost, interrupted, or unavailable network, server, or other connections, garbled transmissions or miscommunications, telephone transmission problems; computer or software malfunctions or technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE ASSOCIATED WITH THIS SWEEPSTAKES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be attempting to tamper with or undermine the entry process, and/or the legitimate operation of the Sweepstakes; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. If, for any reason, the Sweepstakes is not capable of running as planned, Sponsor may, in its sole discretion, void any suspect entries and (a) modify the Sweepstakes or suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) prizes will be awarded at random from among all eligible entries received per Entry Period prior to cancellation up to the time of the impairment.

8. Release and Limitations of Liability: By participating in this Sweepstakes, Entrants agree that the Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of Entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANTS AGREE THAT THE RELEASED PARTIES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF PRIZE, ENTRY, OR PARTICIPATION IN THIS SWEEPSTAKES OR IN ANY SWEEPSTAKES RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. THE RELEASED PARTIES ARE NOT RESPONSIBLE IF PRIZE CANNOT BE AWARDED DUE TO CANCELLATIONS, DELAYS, OR INTERRUPTIONS DUE TO ACTS OF GOD, ACTS OF WAR, NATURAL DISASTERS, WEATHER, OR TERRORISM.

BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANTS AGREE THAT THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONS, INCLUDING DEATH, OR TO PROPERTY ARISING OUT OF ACCESS TO AND USE OF ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY SUCH SITE.

WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING THE PRIZES, ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

9. Publicity: EXCEPT WHERE PROHIBITED BY LAW, WINNERS GRANT TO SPONSOR AND THOSE ACTING PURSUANT TO THEIR AUTHORITY, THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING BUT NOT LIMITED TO THE WORLD WIDE WEB, AT ANY TIME OR TIMES, WINNER’S NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, ENTRY, AND BIOGRAPHICAL INFORMATION FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON TELEVISION OR RADIO BROADCAST) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION. ENTRANTS AGREE THAT SPONSOR SHALL OWN THE ENTRIES, WHICH WILL NOT BE ACKNOWLEDGED OR RETURNED, AND THAT SPONSOR AND ITS DESIGNEES SHALL HAVE THE PERPETUAL, WORLDWIDE RIGHT TO EDIT, PUBLISH, AND USE THE ENTRIES IN ANY WAY AND IN ANY MEDIA FOR TRADE, ADVERTISING, PROMOTIONAL, AND/OR OTHER PURPOSES AS SPONSOR AND/OR ITS DESIGNEES MAY DETERMINE WITHOUT FURTHER CONSIDERATION TO ENTRANTS OR ANY THIRD PARTY.

10. Disputes: Except where prohibited, Sponsor reserves the right to make all decisions in its sole discretion arising out of or relating to the Sweepstakes, and the decisions by Sponsor are final and binding on all matters relating to the Sweepstakes. Except where prohibited, you agree that: (a) any and all disputes, claims and causes of action arising out of, or connected with the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Georgia; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participation in the Sweepstakes, but in no event attorneys’ fees; and (c) notwithstanding the foregoing, you waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the United States of America and the State of Georgia, without giving effect to any choice of law or conflict of law rules (whether of the laws of the State of Georgia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Georgia.

11. PRIVACY: Any personal information that an Entrant provides in connection with the Sweepstakes shall be used by Sponsor to administer this Sweepstakes, contact Entrants, and for the other purposes set forth in the Sponsor’s privacy policy located at https://www.porsche.com/usa/privacy-policy/. By entering this Sweepstakes, you agree to and accept that privacy policy.

12. Winners List: For a list of winners, available after October 11, 2023, send an email to: Winners@dja.com with THE PORSCHE X BACKDROP MAIN STAGE GIVEAWAY WINNERS and 01-2636-12 as the subject line. Winners list will be distributed once all prizes are awarded.
