THE PORSCHE X BACKDROP SCAN THE CAN GAME OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Eligibility: The Porsche X Backdrop Scan the Can Game (The “Game”) is open only to those who possess a web-enabled mobile device and are registered attendees (as of 9/27/23) of the Rennsport Reunion 7 event at the WeatherTech Raceway Laguna Seca, Salinas, CA, on 9/28/2023 – 10/1/2023 (the “Event”) who are legal residents of 50 U.S. and DC are 18 years of age or older as of the date of game play (“Participant”). Void outside the Event and where prohibited by law. Employees of Sponsor, its parent, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional and judging agencies (collectively “Released Parties”), their immediate and extended family members (including but not limited to spouses, domestic partners, parents, children, and siblings and their respective spouses, regardless of where they reside) and household members of each (whether related or not) are not eligible to participate or win. All federal, state and local laws and regulations apply. Participation constitutes Participant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Game. Winning a prize is contingent upon fulfilling all requirements set forth herein.

2. Game Period: The Game between 7:00am Pacific Time (“PT”) and 6:00 pm PT daily from September 28, 2023 through October 1, 2023 (“Game Period”). The Game Period will consist of four (4) daily periods (each a “Daily Game Period”) Each Daily Game Period will begin at 7:00 am PT and end at 6:00 pm PT each day of the Game Period.

3. How to Play: There is NO PURCHASE NECESSARY to participate. A purchase does not increase your chances of winning.During each Daily Game Period, visitors who are present at the Event can participate by locating  Backdrop paint cans, containing a Quick Response (“QR”) code and scanning the QR code with a web-enabled mobile device (“Device”). Players will be directed to the specified website (“Website”), where they will be required to follow the instructions to register with first name, last name, email address, phone number and then click the “Submit” button, to complete their registration and see if they’ve won a prize (“Game Play”). All on-screen wins are subject to verification. All Game Plays become the property of Sponsor. Receipt of Game Plays may be acknowledged, but such acknowledgment does not constitute any representation as to eligibility. Any attempt by any Participant to obtain more winning Game Plays by using multiple/different email addresses, identities, registrations or logins, or any other methods will void that Participant’s Game Plays and that Participant may be disqualified from the Game. Any use of robotic, repetitive, automatic, programmed or similar registration/Game Play methods or agents (including, but not limited to, Promotion Game Play services) will void all Game Plays by that Participant. In the event of a dispute as to any Game Play, the authorized account holder of the email address used to register will be deemed to be the Participant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential prize winners may be required to show proof of being the authorized account holders.
4. Verification/Instant Winner Notification/Instant Winner Prize Fulfillment: All winners are subject to confirmation, verification of eligibility by Administrator and compliance with these Official Rules in Sponsor’s sole discretion. All material submitted becomes the sole property of the Sponsor and will not be returned. If, due to an error of any kind, more instant winning messages are delivered to Participants, or more prizes are claimed than are intended to be awarded per Rule #5, the intended number of prizes will be awarded in a random drawing from among all verified prize claims received during each Daily Game Period. The Sponsor and its agencies assume no responsibility for any injury or damage to Participant’s or to any other person’s mobile device relating to or resulting from Game Play or software in connection with the Game. No responsibility or liability is assumed for damages, losses or injury resulting from acceptance or use of any prize. All prizes will be awarded at the Event and winners must visit the Porsche Backdrop space on Main Street to claim their prize by 6:30 PM PT on the day the prize is won or prize may be forfeited. Winners must be present at the Event to claim their prize. If a winner fails to claim their prize by the end of the Event, the prize will be forfeited. Unclaimed prizes will not be awarded. Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of prize not specifically stated herein are the sole responsibility of the prize winners.

5. Instant Win Prizes/Approximate Retail Values (“ARV”) and Approximate Odds of Winning: Two thousand Prizes (2,000 – 500 awarded per Daily Game Period): A Sponsor-specified key chain (ARV: $9.99 each). Odds of winning depend on the date/time of Game Play, the number of prizes remaining available at the time of Game Play and number of eligible Game Plays received. The number of prizes available to be won will diminish as they are awarded. If a prize becomes unavailable, Sponsor will substitute a prize of equal or greater retail value. No transfer, cash or other substitution of a prize is permitted except Sponsor may substitute prize in whole or in part for one of comparable or greater retail value for any reason. Winners are responsible for any loss of prize after it has been claimed. Sponsor will not replace any lost or stolen prizes. Limit one prize per Participant. Prizes will only be fulfilled to potential winners whose email addresses are associated with the winning Game Play.

6. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Game, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Game, as determined by Sponsor in its sole discretion and in the event of cancellation, the prizes claimed prior to cancellation will be awarded. Released Parties and their agencies are not responsible for lost, late, incomplete, or misdirected Game Plays; lost, interrupted, or unavailable network, server, or other connections, garbled transmissions or miscommunications, telephone transmission problems; computer or software malfunctions or damage to a user’s mobile device (software or hardware); technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

WARNING: ANY ATTEMPT BY AN PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE ASSOCIATED WITH THIS GAME OR UNDERMINE THE LEGITIMATE OPERATION OF THE GAME MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be attempting to tamper with or undermine the Game Play process, and/or the legitimate operation of the Game; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. If, for any reason, the Game is not capable of running as planned, Sponsor may, in its sole discretion, void any suspect Game Plays and (a) modify the Game or suspend the Game to address the impairment and then resume the Game in a manner that best conforms to the spirit of these Official Rules, and prizes claimed prior to cancellation will be awarded.

7. Release and Limitations of Liability: By participating in this Game, Participants agree that the Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Participants, printing errors or by any of the equipment or programming associated with or utilized in the Game; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Game Play or the Game; (4) technical or human error which may occur in the administration of the Game or the processing of Game Plays; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Participant’s participation in the Game or receipt or use or misuse of any prize. BY PARTICIPATING IN THIS GAME, PARTICIPANTS AGREE THAT THE RELEASED PARTIES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY PARTICIPANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF PRIZE, GAME PLAY, OR PARTICIPATION IN THIS GAME OR IN ANY GAME RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. THE RELEASED PARTIES ARE NOT RESPONSIBLE IF PRIZE CANNOT BE AWARDED DUE TO CANCELLATIONS, DELAYS, OR INTERRUPTIONS DUE TO ACTS OF GOD, ACTS OF WAR, NATURAL DISASTERS, WEATHER, OR TERRORISM.

BY PARTICIPATING IN THIS GAME, PARTICIPANTS AGREE THAT THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONS, INCLUDING DEATH, OR TO PROPERTY ARISING OUT OF ACCESS TO AND USE OF ANY WEBSITE ASSOCIATED WITH THIS GAME.

WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS GAME, INCLUDING THE PRIZES, ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

8. Publicity: EXCEPT WHERE PROHIBITED BY LAW, WINNERS GRANTS TO SPONSOR AND THOSE ACTING PURSUANT TO THEIR AUTHORITY, THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING BUT NOT LIMITED TO THE WORLD WIDE WEB, AT ANY TIME OR TIMES, WINNER’S NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, GAME PLAY/ENTRY, AND BIOGRAPHICAL INFORMATION FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON TELEVISION OR RADIO BROADCAST) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION. PARTICIPANTS AGREE THAT SPONSOR SHALL OWN THE GAME PLAYS, WHICH WILL NOT BE ACKNOWLEDGED OR RETURNED, AND THAT SPONSOR AND ITS DESIGNEES SHALL HAVE THE PERPETUAL, WORLDWIDE RIGHT TO EDIT, PUBLISH, AND USE THE GAME PLAYS IN ANY WAY AND IN ANY MEDIA FOR TRADE, ADVERTISING, PROMOTIONAL, AND/OR OTHER PURPOSES AS SPONSOR AND/OR ITS DESIGNEES MAY DETERMINE WITHOUT FURTHER CONSIDERATION TO PARTICIPANTS OR ANY THIRD PARTY.

9. Disputes: Except where prohibited, Sponsor reserves the right to make all decisions in its sole discretion arising out of or relating to the Game, and the decisions by Sponsor are final and binding on all matters relating to the Game. Except where prohibited, you agree that: (a) any and all disputes, claims and causes of action arising out of, or connected with the Game or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Georgia; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participation in the Game, but in no event attorneys’ fees; and (c) notwithstanding the foregoing, you waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Game, shall be governed by, and construed in accordance with, the laws of the United States of America and the State of Georgia, without giving effect to any choice of law or conflict of law rules (whether of the laws of the State of Georgia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Georgia.

10. PRIVACY: Any personal information that an Participant provides in connection with the Game shall be used by Sponsor to administer this Game, contact Participants, and for the other purposes set forth in the Sponsor’s privacy policy located at https://www.porsche.com/usa/privacy-policy/. By participating in this Game, you agree to and accept that privacy policy.
